Terms of Use
In short: Together is a coordination tool for parents. It does not give legal advice, and an approval between parents in the app is not an agreement or a court decision. Subscriptions are bought and cancelled through the App Store or Google Play. What you write stays yours and is your responsibility, and abusive messages can be blocked and reported. The app, its name, logo and Shiko are ours and may not be copied.
1. Who we are and when these terms apply
The Together app (ביחד ולחוד) and this website are operated by Ben Levy, a licensed dealer (Osek Murshe) trading as BH Projects, 20 Yechia Adhan St., Jerusalem 9510314, Israel, bhpro26@gmail.com ("we"). By opening an account or using the app you accept these terms and the Privacy Policy. If you do not accept them, do not use the app.
2. Who may use it
- A parent or guardian of a child, aged 18 or over. Children have no account.
- One account per person. Keep your sign-in details to yourself. If you think someone else used your account, change your password and contact us.
- Enter accurate details, and details about another person only if you are entitled to.
3. The service
The app helps two parents coordinate their children's life in two homes: a custody calendar, holidays and vacations, swap requests and approvals, chat and urgent messages, child reminders, expenses, child support and balance, and an AI assistant that understands short requests. A family in the app has up to two parents, and what is saved in it is visible to both.
We keep improving the app, so features may change, be added or be removed. We will not remove a core feature you subscribed for without advance notice in the app. The app is available in Israel and in other countries we choose in the stores, but not in the European Union.
4. Not advice, not a legal document
- The app, the AI assistant, the calculations and templates are not legal, medical, psychological, financial or tax advice. For questions about custody or child support, consult a lawyer, mediator or other professional.
- An approval between the parents in the app is not a binding agreement and not a court decision. It does not change an existing agreement, judgment or order. If they conflict, the agreement or the court decision prevails.
- Child-support, indexation, expense-split and balance figures are aids based on the data you entered. Check them before relying on them.
- Reports and exports are for your own use. We do not promise that they will be accepted as evidence, and we are not a party to any proceeding between the parents.
- The app is not an emergency service. In an emergency call the police (100), Magen David Adom (101) or the relevant service. Do not rely only on a notification for something important to a child's health or safety.
5. The AI assistant
The AI assistant (Shiko) works only after you consent and uses OpenAI's service as described in the Privacy Policy. It shows what it understood and saves only after you confirm. It can be wrong: check its suggestion before you confirm. Reasonable usage limits apply and may differ between free and paid plans.
6. Subscriptions, prices and cancellation
- Free and paid: part of the app is free and part needs a subscription (personal or family). What each includes is shown in the app before purchase. A parent without a subscription can always view, approve or decline a request the other parent sent.
- Family plan: also covers the other parent of the same family, on any device. If the payer cancels, leaves the family or deletes the account, the other parent's coverage ends at the end of the paid period (and after any grace days shown in the app). The family's data is not deleted because of this.
- Purchase: subscriptions are sold only in the app, through Apple's App Store or Google Play. Billing, invoice and receipt are handled by the store. The final price including VAT, the period and the renewal terms are shown on the purchase screen before you confirm.
- Auto-renewal: a subscription renews at the end of each period unless cancelled at least 24 hours before the period ends. If there is an introductory offer or free month, billing starts when it ends unless you cancel first.
- Cancellation: cancel at any time in the store's subscription settings (see support). Cancelling stops renewal; access stays until the end of the paid period. Deleting the account or the app does not cancel a subscription.
- Refunds: refund requests go to Apple or Google under their procedures. Nothing in these terms limits your rights under the Israeli Consumer Protection Law, 5741-1981, including the right to cancel a continuing transaction. If you believe the law entitles you to a refund, write to us and we will help you with the store.
- Launch period and price changes: during a launch period the whole app may be open until a date shown in the app; afterwards some features move to the subscription without losing your data. We announce a price increase for an existing subscription in advance through the store and under its rules, and you can cancel before it applies.
- The app does not move money between parents. A button that opens a payment app only opens an outside app; the transfer is between you and that payment provider.
7. Your content and conduct between parents
- Content you enter (messages, photos, notes, expenses) stays yours and is your responsibility. You allow us to store and show it and pass it to the other parent and to our service providers only to run the service (details in section 8.6).
- Do not use the app to threaten, harass, defame, invade privacy, send sexual or violent content, upload material you have no right to, impersonate, attack security or break the law. Do not upload agreements, court decisions, identity documents or medical information.
- Messages pass an automatic filter of offensive phrases, and a blocked message is not sent. You can block the other parent and report a message to us ("Report to support"). A report sends us the text of the reported message (not images), and the other parent is not notified. We review reports promptly.
- If we find a breach, we may remove content, limit features or suspend an account, proportionately. We will usually tell you and let you respond, unless there is a risk of harm or the law prevents it.
8. Intellectual property
8.1 What is ours
The app and the website belong to us, or we are licensed to use them: the code, design and interface, the logo (two houses with a child between them), the names "ביחד ולחוד" and "Together", the assistant character Shiko (its name, look and personality), the texts and explanations, templates, sounds, animations and the structure of the information. All rights not expressly granted to you in these terms are reserved.
8.2 Your licence
We give you a personal, limited, non-exclusive, non-transferable and non-sublicensable licence to install the app on your devices and use it to coordinate your family's matters, under these terms and the rules of the store you downloaded it from. The app is licensed, not sold, and the licence gives you no ownership of it. The licence ends when your account is deleted, when you stop using the app, or if you materially breach these terms.
8.3 What you may not do
- Copy, modify, translate, distribute, sell, rent or publish the app or any part of it, including its design, texts, sounds and the Shiko character.
- Reverse-engineer, decompile or disassemble the app or try to extract its source code, except where the law expressly allows it despite this restriction (for example to make other software interoperable with it, under the Israeli Copyright Act, 2007), and only as far as needed for that purpose.
- Collect data from the app, the server or the website with automated tools (crawling, scraping, bots), access the server other than through the app, circumvent usage or security limits, or overload the service.
- Use the app, its content or its server interface to build a competing service or a database.
- Remove, hide or alter any copyright, trademark or licence notice.
- Use our names, logo or the Shiko character, or a confusingly similar name or sign, without our written permission, for example in the name of an app, website, social-media account or advertisement, or suggest a connection with us that does not exist.
8.4 Trademarks
"ביחד ולחוד", "Together", the logo and the Shiko character are our trademarks, even where some are not yet registered. Apple, App Store, iPhone and Apple Weather are trademarks of Apple Inc. Google, Google Play and Android are trademarks of Google LLC. OpenAI is a trademark of OpenAI. Third-party names and logos appear only to describe their services and do not mean that they are connected with or endorse the app.
8.5 Open source and third-party data
The app includes open-source components and third-party data, for example Tesseract and Leptonica, which read receipts on the phone, and weather data. They are governed by their own licences and terms, not by section 8.2. The list and the full licence texts are in the app: Family › My account › Open-source licences. The source of the weather data is shown on the weather screen. Nothing in these terms limits any right an open-source licence gives you.
8.6 Your content
- It stays yours. You keep the rights in the content you write or upload (messages, photos, notes, receipts, reminders). We do not become its owner.
- The permission you give us, only for the service. You give us a non-exclusive, royalty-free licence, in the places where our servers and service providers are, to store and back up the content, make technical copies of it, resize and compress photos and strip their location data, show it to you and to the other parent of the family, and pass it to the service providers listed in the Privacy Policy, only to run, secure and support the service and to review reports. We do not publish your content and do not use it for advertising, marketing or training AI models.
- When the permission ends. When the content is deleted, except for backup copies until they roll over (at most 30 days) and shared records that stay for the other parent after an account is deleted, as described on the account deletion page.
- What you confirm. That you have the right to upload the content: you took the photo or may use it; a photo of another person (an adult, or a child who is not yours) is uploaded only with their consent or their parents' consent; you do not upload someone else's work (an image from the internet, a drawing, a text) without permission; and the content does not infringe anyone's copyright, trademark, privacy or other right. You are responsible for content you upload, to the extent the law allows.
- Text the AI assistant drafted. Wording the assistant suggested at your request (for example a message to the other parent) is for your use, and we claim no rights in it. The assistant may produce similar text for other users.
8.7 Infringement claims (notice and takedown)
If you believe that content in the app or on the website infringes your copyright, trademark, privacy or another right, email bhpro26@gmail.com with the subject "Infringement claim" and include:
- Your name and contact details and, if you act for someone else, on whose behalf.
- Which right you believe was infringed and what it is based on (for example a link to the original work, or the trademark registration number).
- Where the content is, in enough detail to find it (for example a screenshot and a date). A family's content is visible only to its two parents, so good detail helps us find it without exposing other people's data.
- A statement that you believe in good faith that the use is not authorised by the rights holder or by law, and that the details in your notice are accurate.
We confirm receipt within 7 days. If details are missing, we ask for them. If the claim is detailed and appears well-founded, we remove or block the content or restrict access to it promptly and tell the person who uploaded it. We do not give them your details beyond what is needed to look into the claim, unless you agree or the law requires it.
Counter-notice: a person whose content was removed may reply to the same address, explain why the content does not infringe (for example that they own the right, have permission, or the use is fair use) and confirm that the details are accurate. We pass the reply to the claimant. If within 14 days of passing it on the claimant has not told us that they have started legal proceedings, we may restore the content. We do not decide disputes over rights; that is for a court.
Repeat infringers: in appropriate circumstances we suspend or close the account of someone who repeatedly uploads infringing content. Knowingly filing a false claim may make you liable for the damage it causes.
8.8 Ideas and suggestions
If you send us an idea, suggestion or feedback about the app, we may use it to improve the service, without payment or any duty to give credit, and without revealing who suggested it. Do not include anything you want to keep confidential. Personal data in your message is handled under the Privacy Policy.
8.9 Third-party claims against the app
If anyone claims that the app, or your use of it under these terms, infringes their intellectual property, we, not Apple or Google, are responsible for investigating, defending, settling and discharging the claim.
9. Liability
- We make reasonable efforts to keep the app working, accurate and secure, but it is provided as is. Faults, delayed notifications or outages can happen.
- To the extent the law allows, we are not liable for decisions made between the parents, for content written by a user, for an unchecked AI answer, or for indirect or consequential loss.
- To the extent the law allows, our total liability to you is limited to what you paid for the subscription in the 12 months before the event, or ILS 100, whichever is higher.
- This section does not limit liability for intent or gross negligence, liability that cannot be limited by law, or your consumer rights.
10. Ending
You can stop using the app and delete your account at any time (account deletion). We may end the whole service with at least 30 days' notice in the app, and will let you export reports first. Sections that by nature continue (liability, law) keep applying.
11. Apple and Google
These terms are between you and us, not Apple or Google, and we (not they) are responsible for the app and its support. Use of an app downloaded from the App Store is also subject to Apple's Standard EULA, and Apple and its subsidiaries are third-party beneficiaries who may enforce these terms. Use of an app downloaded from Google Play is also subject to the Google Play terms. Where a store requires a rule, the store's rule prevails.
- An app downloaded from the App Store may be installed and used only on Apple-branded devices that you own or control, as the App Store Usage Rules allow.
- Apple and Google have no obligation to provide maintenance or support for the app. If the app fails to meet a warranty that applies to it by law, you may notify Apple, and Apple will refund the purchase price of the app, if any. Beyond that, Apple is not responsible for any claim relating to the app, including product liability, failure to meet legal requirements, consumer protection, privacy and intellectual-property claims (see section 8.9). Those claims are to be addressed to us.
- You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
12. Law and courts
Israeli law governs these terms. The competent courts in Jerusalem have jurisdiction, without limiting a consumer's right to sue in another competent court under the law. Before going to court, please write to us and we will try to resolve the matter.
13. Changes
If we change these terms, we update the version and date on this page. We announce a material change to your detriment in the app 30 days before it applies, and you can cancel your subscription and delete your account before then.
